It is your responsibility to carefully read this Agreement and to understand all of your rights and obligations before you decide to sell your excess baby formula to SellFormula.com.
By agreeing to send your excess baby formula to SellFormula.com, you are agreeing and accepting the terms & conditions below:
1) I am an individual 18 years of age or older.
2) I am the sole and rightful owner of the item being sold to SellFormula.com.
3) I understand that SellFormula.com is a medium for selling excess baby formula that I lawfully own or possess with rights to sell.
4) If any item is discovered to have been lost or stolen, I will not receive compensation for the item provided to SellFormula.com.
5) SellFormula.com will not accept or provide compensation for baby formula that have been opened or otherwise tampered with. All boxes must retain their original, unbroken seal.
6) SellFormula.com will not accept or provide compensation for baby formula that are expired upon receipt of delivery or have less than six months left to their expiration.
7) Sellformula.com does not purchase any items received from WIC or any other government program.
8) I agree I will only send baby formula that have not expired and will not expire for at least six months from the date of shipment.
9) I understand that I am solely responsible for the condition of the baby formula upon its arrival to SellFormula.com.
10) SellFormula.com will only return Baby Formula if return postage has been provided.
11) I agree that the value assigned to the baby Formula before shipment may vary after its receipt and inspection by SellFormula.com and may be less than the estimated value quoted.
12) I agree that I am transferring all rights, title and interest in the baby formula to SellFormula.com upon the receipt and inspection of the baby formula by SellFormula.com.
13) I understand that SellFormula.com has not made any representation as to value assigned to the baby formula with regards to a fair market value.
14) I agree that SellFormula.com and any affiliates and/or partners, including but not limited to SellFormula.com have no liability with regards to the final value assigned by SellFormula.com for the baby formula.
15) SellFormula.com, its affiliates, and any partners, including but not limited to SellFormula.com, shall not be liable for any damages, whether indirect, consequential, special or punitive, incidental or exemplary, foreseeable or unforeseeable, arising out of this Agreement.
16) I agree to settle any dispute with respect to the purchasing program and SellFormula.com by arbitration governed by the Federal Arbitration Act in the borough of Lakewood, NJ with each party paying one-half of the cost of the arbitration proceeding.
17) I acknowledge that it is a violation of Federal regulations to attempt to sell or gift formula that was obtained through the WIC Program. By submitting any material containing your name and contact information (address and/or email) you agree that your contact information may be shared with the Federal WIC Program.
18) I further agree that by entering into this Agreement and/or conducting business with SellFormula.com, I am waiving the right to a trial by jury and agree to only bring claims in my individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
SellFormula.com does not buy sample products, dented & dinged product, expired products or products that are within 6 months to expiration dates. If SellFormula.com deems a product not suitable for purchase, you can request to have it returned within SEVEN days of SellFormula.com receiving it. Formula will be sent at SELLERS expense. Any product not claimed within 30 days of SellFormula.com receiving it, will be disposed of and SellFormula.com will NOT be held responsible for it.
